Yep, same issue here with my MacBook Late 2008, Aluminum. So, the SuperDrive that holds the discs is slightly warped in some way, so when you tilt the Mac, the disc will hit the superdrive case.

My recommendation: if the superdrive works fine while the Mac is flat, you could probably continue to use it without too many issues. Just keep a close eye on it.
